Need to Keep Your License?
The reality of living in California is that most people need to drive. These days we live further from work and school so a license to drive is a critical necessity of life. A DUI arrest can result in an automatic license suspension thirty days later. You will have ten days from the date you were given notice to take action to stop the automatic suspension.
You should almost always request a hearing to contest the proposed suspension. The issues decided at the hearing are very limited:
- Were you driving?
- Were you lawfully arrested?
- Was your blood alcohol level equal to or greater thanĀ 0.08% while you were driving?
In other cases you may be facing a suspension if you have accumulated too many points on your license. If this is the case you are at risk of a suspension of your driver’s license for being a “Negligent Operator.”
